You work every day to grow your nest egg, reach your financial goals, and look after your family. Your hard work and the people you care about should be protected by proper estate planning. Estate Planning means thinking through difficult scenarios and having a plan that is memorialized in enforceable legal documentation.

Our Will, Estate, and Trust Services:

Wills.

Estate planning begins with your Will. Using our Wills Questionnaire (linked below) we conduct a thorough audit of your finances, family, and final wishes to ensure that your Will memorializes exactly what you intend it to. The importance of having a Will is paramount, as those who pass away without a Will are subject to the distribution scheme determined by the government, which does not take in to account your final wishes, your family dynamic, or your desire to reduce probate taxes.

Our comprehensive Wills often contemplate:

  • The distribution of your estate to beneficiaries and to registered charities

  • If you predecease your minor children, then who will act as their guardian(s) and how they will be financially supported

  • Creating trust funds for beneficiaries who are underage at the time of your passing & intricate powers for the Trustee to grow and invest the trust monies

  • Other final wishes such as specific gifts, burial wishes, etc

Proper estate planning ensures that your family is looked after, effectively plans to reduce taxes, and seeks to avoid costly disputes among your beneficiaries.

Powers of Attorney.

Powers of Attorney are a cornerstone of estate planning. They authorize your Attorney(s) to act on your behalf if you are unable to do so. They generally concern:

  • Banking

  • Real estate

  • Corporate affairs

  • Insurance

There are a variety of types and structures of Powers of Attorney, meaning that they are largely customizable. We can advise you on the form that best suits your situation.

Representation Agreements.

The easiest way to think about Representation Agreements is to think of them as Powers of Attorney that concern the provision of care of an adult. Representation Agreements authorize your Representative(s) to make decisions surrounding the provision of care, personal affairs, and living arrangements of an adult who is no longer able to make these kinds of decisions.

Representation Agreements provide instructions by the adult to the Representative, such as the intention to continue living at home as long as possible or to an appropriate care facility that is close to family and friends.
